The role of the DER, or Designated Employer Representative, in a drug testing program is not only essential for compliance (especially in federal/DOT testing programs), but also for fostering a safe workplace.

The DER is the main point of contact for whomever conducts drug and alcohol screens for the company (this could be a clinic, or a business that offers third-party administration of drug screen programs). Only the DER is allowed to receive drug and alcohol test results from the administrators of those tests. 

DER Responsibilities

But the DER does much more than just act as a point of contact:

  • DERs are responsible for coordinating their company’s drug screen program, oftentimes with a third-party testing agency. In a federal/DOT situation, the DER must be aware of all rules and regulations regarding federal tests.
  • DERs keep records of drug and alcohol tests, including the original chains of custody for the tests.
  • DERs are tasked with making important decisions regarding testing, for instance making sure safety-sensitive employees are removed from their positions upon receipt of a positive drug or alcohol test.
  • The DER is the company point person for ensuring compliance with company policy as well as local, state, and federal testing regulations. Therefore the DER must be properly trained in drug and alcohol testing procedures, relevant laws, and all company policies. 
  • The DER is responsible for ensuring that company employees are appropriately informed about company drug and alcohol policies and the consequences for non-compliance.

In the complex landscape of drug testing programs, the Designated Employer Representative serves as a linchpin, ensuring safety, compliance, and accountability within their organization.
